Official Raffle Rules

IRISH WOLFHOUND ASSOCIATION OF THE CAROLINAS 2024 “HOUNDS OF EIRE” Raffle Official Rules
 

Irish Wolfhound Association of the Carolinas (“IWAC”), a North Carolina nonprofit corporation Section 501(c)(4) of the Internal Revenue Code, is conducting a “Hounds of EIRE” Trip to Ireland Raffle (the “Raffle”) to raise funds for its ongoing charitable activities and mission.

The rules (the “Rules”) of the Raffle, set forth below, govern the Raffle, award of prizes, and participation in the Raffle. These Rules bind every person (an "Entry Holder”) who buys or holds a Raffle entry. By purchasing or holding an entry, each Entry Holder agrees (a) to be bound by these Rules and (b) that IWAC’s interpretation and application of these Rules is conclusive and final.

 

The Grand Prize Drawing for the Raffle will take place on May 31, 2024 (the “Grand Prize Drawing Date”). The final entry purchase deadline is May 31, 2024 at 12:00 noon.  Only 600 entries will be sold. As set forth in the “Prizes” section below, the Grand Prize that IWACS will award has an equivalent value of $3500. If less than 100 entries are sold the raffle will be cancelled and all monies will be returned to entry holders.
 

All drawings are open to the public, but the winner need not be present to win.


Raffle Ticket "Entry" Information
 

Raffle Ticket "Entry" Cost: each (1) (one) entry is $35.  A $5 fee will be added to the total cost of each purchase at the time of check out. No price breaks for quantity.
 

Each Eligible Entry Purchaser (as defined below in the “Eligibility” related sections of these Rules) may purchase a ticket. Once they do, they become the “Ticket Purchaser”.  This means, the Entry Purchaser is the name on the entry(ies) and they become the "Entry Holder” for the amount of entries they purchased.

Ticket "Entry" Holder Name and Designation of Prize:
An Eligible Ticket "Entry" Purchaser may designate another person as Entry Holder for purposes of bestowing the winning entry and trip on another person if they so desire.  The prize winner of the winning entry is deemed the person named on the entry as the Entry Purchaser.  They will be declared the winner and the prize will be awarded to them.  The subsequent division of the prize shall be the sole responsibility of the first person named on the entry.

Once IWAC awards the prize to the person named on a entry, IWAC will have no further duties or obligations with respect to the division of the prize and the person named on a entry as the Entry Holders releases IWAC from all claims relating to the award of the prize or its division among other persons.

Raffle Tickets "Entries" are Not Considered Charitable Contributions:
The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions.

 

Purchaser and Ticket "Entry" Holder Eligibility:
To be eligible to purchase an entry, an entry purchaser (an “Eligible Entry Purchaser”) must (a) be at least 18 years old at the time of purchase, (b) be a U.S. resident physically residing in the United States or District of Columbia, and (c) not be precluded by Applicable Law (as that term is defined in the “Registration with the State of North Carolina and Applicable Law” section of these Rules”) from holding or purchasing a ticket or participating in a raffle.

 

A person cannot be an Eligible Entry Purchaser or a Entry Holder if such person or holder is a person (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List”) or under any statute or executive order or (b) who is acting, directly or indirectly, for or on behalf of any such person.

IWAC Board members and their family members are eligible to purchase entries and win a prize.  
 

IWAC reserves the right to require reasonable evidence of the eligibility of an Eligible Entry Purchaser or Entry Holder at any time and to void any entry sold to a person who does not meet the eligibility requirements or who is precluded by applicable law from holding a entry or participating in a raffle.


How to Purchase Tickets "Entries":
Eligible Entry Purchasers may purchase Raffle entries by going to https://go.rallyup.com/houndsofeire2024   Purchases may be made by credit or debit card.

Entry numbers will be assigned in the order that payment is received.  All payments are deposited upon receipt.  Purchases will receive an e-mail confirmation of their entry(ies), and a subsequent e-mail with a link to the livestream drawing on May 31, 2024.
 

In accordance with Applicable Law, IWAC will not mail Raffle entries to Entry Holders.  To win a prize, Ticket Holders do not need (a) to possess a hard copy of a Raffle entry or a receipt in order to win and (b) do not need to be present at a drawing.
 

All Raffle entry sales are final. IWAC will make no refunds with the exception that IWAC will return any payment that IWAC receives after the Final Entry Purchase Deadline. No other refunds are available except at the discretion of IWAC.  IWAC assumes no responsibility for lost, late, misdirected, or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.


Odds of Winning:
The odds of winning one or more prizes will depend on the number of entries sold. If IWAC sells all 600 entries, the odds of winning the Grand Prize are 1 in 600. The chance of winning the Grand Prize, and secondary prizes is based upon the number of entries sold, and if IWAMS sells less than 600 entries or adds additional drawings or prizes, the chance of winning a prize will increase.

 

Prize & Drawing Information
 

GRAND PRIZE DRAWING:
 

Purchase Deadline:  Online credit card/debit card entry purchases up to May 31, 2024 at 12:00 noon EST.
Drawing Date & Time: May 31, 2024 via online live stream, beginning at 6:00 p.m. EST.

Drawing Location:

Drawing will be conducted by the website RallyUp.com and participants will be invited to view the drawing via the platform's online streaming link which will be e-mailed to each ticket purchaser.

Grand Prize:
One trip to the location of winner's choosing, with an equivalent value of $3500.  This is non-transferrable into cash.
 

Grand Prize If Less Than 600 Tickets "Entries" Sold:
If IWAC sells a minimum of 100 entries by the Final Entry Purchase Deadline, the awarding of all prizes is not dependent on the number of entries sold.


Net Raffle Proceeds:
As used herein, the term “Net Raffle Proceeds” means (a) the gross proceeds received by IWAC received from the sale of entries in the Raffle less (b) any payment required for the other prizes (whether or not claimed or awarded in the Raffle), and all Raffle-related expenses as determined by IWAMS. The determination by IWAC will be binding in all events other than a manifest error made by IWAC in the computation of the revenues and expenses of the Raffle.

 

"Hounds of EIRE" Trip to Anywhere Grand Prize:
The Grand Prize of a Trip to Anywhere is roundtrip from any continental US domestic airport where noted. Travel is transferrable. Travel arrangements are made between vacation prize winners and the travel agent arranged by IWAC. Travel must be used within one year of the IWAC Grand Prize drawing date. The tax on the value of the Grand Prize ($3500) will be the responsibility of the Ticket Holder. The Grand Prize has a maximum value of no more than three thousand five hundred dollars in total.  The value of the prize is not transferrable to cash or other items of equal value.  It is applied to a trip only.  The winner of the Grand Prize and/or their prize designees must comply with all applicable requirements and restrictions related to the prize including without limitation applicable travel dates, age restrictions, liability waivers, travel documentation and reservation and confirmation procedures. All trips are subject to availability and the Grand Prize winner will be encouraged to make plans early to maximize their winning value.

 

Prize Selection for Prizes Other than the Grand Prize:
Within 45 days following the drawing, the Prizewinners selected must elect either an Irish Wolfhound themed prize, or a non Irish Wolfhound themed prize by giving notice to IWAC and complying with the requirements of the following section. If the Prizewinner fails to make an election in the manner hereinafter provided, or if the Prizewinner fails to comply with the requirements regarding the award of prizes, then the prize will be forfeited. 

 

Prize Restrictions:
If selected, the prize will be offered to the winner in “as is” condition, without warranty of any kind, express or implied.  The prize and any noted defects if there are any discernible, are described on the website https://go.rallyup.com/houndsoreireraffle   The prize is awarded to the winner, and is non-assignable and non-transferable by the IWAC.  Reasonable efforts will be made for the winner to take delivery of the prize within 45 days of the drawing or, if not possible to deliver to the winner, the prize may be forfeited.

Addition of Prizes:
IWAMS may add additional prize choices at any time.  It is the obligation of IWAC to inform all purchasers of tickets, both past and future, of these additions via email if an email is provided at the time of purchase, and via any other means available.

 

Drawing Procedures:

May 31, 2024 via online live stream, beginning at 6:00 p.m. EST.  Drawing will be conducted by the website RallyUp.com and participants will be invited to view the drawing via the platform's online streaming link which will be given to each ticket purchaser.

At the discretion of IWAC, it may extend or modify ticket purchase deadlines and the drawing date, time, and location if needed. A list of Raffle winners will be posted on www.iwams.com, in the Irish Wolfhound Association of the Carolinas newsletter and Facebook group, and on the IWAC Facebook page.  The IWAC Board of Directors (5 members) is the final authority in the event of any disputes regarding any of the drawings.


Order of Prize Drawings:
A Raffle ticket will be drawn for prizes in reverse order.  The first choice of secondary prizes will coincide with the first name on the ticket, ending with the final name drawn and prize choice.  If the person named is not present, then prizes will be offered in order of those drawn by email until all secondary prizes have been awarded.  No Raffle ticket can win more than one prize. All tickets will be re-entered to be eligible for the Grand Prize Drawing.  In the event a secondary prize winner name wins the Grand Prize, another name will be chose for a secondary prize.  That name will take the place of the Grand Prize winner’s name in the order of secondary prize choices.  The drawing event will then conclude with the drawing of the Grand Prize.

 

Eligible Ticket Requirements:
Any Ticket Holder must be named on each ticket they purchase in the same way, using one method of payment, using the same name on each ticket, and the same mailing address for each eligible ticket. For each eligible entry number assigned, a corresponding eligible entry number will be added into the online drawing.  Three entries assigned will have three entries entered into the Drawing, four entries assigned will have four entries entered into the Drawing, etc.  There are no discounts for multiple entries purchased at the same time.

 

Notification of Winning:
IWAC will make reasonable efforts to contact prizewinners using information provided on the corresponding winning Entry Holder’s purchase email. If a prizewinner does not contact IWAC within 30 business days after the first initial contact notifying the prizewinner of their winnings, then IWAMS shall give notice to such prizewinner by U.S. Postal Service certified mail, return receipt requested, at the address set forth in the information provided by the Eligible Ticket Purchaser. This notice shall state (a) the prize won, (b) a telephone number of a contact person at IWAC, (c) the time and location where the prize can be claimed or arrangement suitable for getting the prize to the winner, and (d) that if the prize has not been claimed within 45 days of the date the notification is given, that IWAC may, at its option, retain the prize.

 

Eligibility to Win:
IWAC will not award a prize if the prizewinner (a) was ineligible to purchase an entry or otherwise enter the Raffle, (b) provided materially false or misleading information to IWAMS in connection with the purchase of a raffle ticket, or (c) if participating in this Raffle or receiving a prize is prohibited with respect to such person pursuant to these Rules or Applicable Law. No other Raffle ticket will be substituted for a Raffle ticket, and IWAC will retain the prize. A Ticket Holder cannot assign or transfer his/her interest in a Raffle ticket or a prize won by a winning Raffle ticket until after they have taken possession of it.

 

Winner Authentication:
As a condition to being eligible to receive a prize, each prizewinner MAY be asked to sign and deliver to IWAC, depending upon the prize won: (a) a sworn affidavit of eligibility under these Rules and Applicable Law and satisfactory proof that he/she is the person named on the winning entry; (b) a correct taxpayer identification number (e.g., social security number, individual taxpayer identification number, or employer identification number), (c) satisfactory proof that the purchaser of the ticket was an Eligible Ticket Purchaser at the time the ticket was purchased; (d) a publicity release, and (e) such other matters as IWAMS may reasonably request, such as proof of identification and proof of address to determine authenticity of individual claiming a prize. If the holder of a winning ticket does not provide a correct taxpayer identification number or otherwise comply with Applicable Law or these Rules, then IWAC may, at its option, disallow the award of the prize to such Ticket Holder and retain the prize.

 

Payment Income Tax on Grand Prize Value:
Winners of the Grand Prize (valued at $3500) are responsible for paying the required tax amount and reporting the award of the Raffle Grand Prize in accordance with Applicable Law. 

 

Media Use:
Each Entry Holder agrees their name, likeness, city of residence and state may be used in any print or social media without notice or compensation for any purpose including related to this IWAC Raffle or promotional materials.

 

Liability:
Each Entry Holder (a) agrees IWAC, its directors, officers, agents, and representatives are not responsible for any injuries, losses, or damages of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless IWAMC (as that term is defined in the “Additional Rules Applicable to the Grand Prizewinner” section of these Rules) and their officers, directors, agents, insurers, attorneys, accountants, and affiliated entities from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of any prize, or that person’s failure to comply with Applicable Law; and (c) represents and warrants to IWAMS that they have read and understand these Rules and agree to be bound by these Rules and IWAC’s decisions, which are final.

 

Dispute Resolution:
All claims and disputes arising under or relating to the award of a prize or the conduct of the Raffle, IWAC and all persons purchasing or holding a ticket agree to settle the dispute by binding arbitration in the state of North Carolina, or another location mutually agreeable to the parties. The arbitration shall be conducted on a confidential basis pursuant to, and governed by, the United States Arbitration Act (9 U.S.C. §§ 1-16). Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys' fees. Any such arbitration shall be conducted by an arbitrator experienced in Non-Profit Fundraising and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction. While such arbitration is pending, IWAC, in its sole and absolute discretion, will keep the prize value in reserve deposit until the dispute is resolved by arbitration.  By the purchase of a ticket, all persons purchasing or holding a ticket (a) do submit themselves to the jurisdiction of the appropriate court and appoint the then Clerk, or acting Clerk, of said court as their Agent for the service of all process in connection with such proceedings and consent to the arbitration of disputes between them.  

 

The Laws of the State of North Carolina and Applicable Law:
This Raffle is being conducted pursuant to the laws of the State of North Carolina and Applicable Law.  If there is a conflict between these Rules and the laws of the State of North Carolina, the laws of the State of North Carolina shall govern.  IWAMC reserves the right to modify the Rules and/or impose additional conditions, procedures, and requirements as may be necessary or required for the Raffle and the award of prizes here under to comply with the laws of the State of North Carolina and Applicable Law. This Raffle is void where prohibited by law and in states where raffles are prohibited by law.
