2025 “HOUNDS OF EIRE” Raffle

Official Rules and Regulations

The Irish Wolfhound Association of the Carolinas (“IWAC”), a North Carolina nonprofit corporation Section 501(c)(4) of the Internal Revenue Code, is conducting a “Hounds of EIRE” Grand Prize Trip Raffle (the “Raffle”) to benefit the Irish Wolfhound rescue efforts conducted by the Irish Wolfhound Rescue of the Mid South (IWRMS), a 501(c)3 Charitable Organization. The rules (the “Rules”) of the Raffle, set forth below, govern the Raffle, award of prizes, and participation in the Raffle. These Rules bind every person (an "Entry Purchaser” or an “Entry Holder”) who buys or holds a Raffle entry. By purchasing or holding an entry, each Entry Purchaser or Holder agrees (a) to be bound by these Rules and (b) that IWAC’s interpretation and application of these Rules is conclusive and final.

 

Raffle Ticket "Entry" Information and Designation of Prize:

The Grand Prize Drawing for the Raffle will take place at 6:00 PM EST, June 1, 2025.

The final entry purchase deadline is 12:00 noon EST, June 1, 2025.   

No more than 600 entries will be sold. The awarding of any/all prizes is not dependent upon reaching that maximum of 600.

The odds of winning will depend upon the number of entries sold. If the maximum 600 entries are sold, the odds of winning the Grand Prize are 1 in 600. The chance of winning any of the prizes is based upon the number of entries sold and the number of total prizes; if there are fewer than 600 entries or if additional Runner Up prizes are added, the chance of winning a prize will increase.

NOTE: If less than 100 entries are sold, the raffle will be cancelled, and all monies will be returned to entry holders.

All drawings are open for view to the public; the winners need not be present to win.

Raffle Ticket "Entry" Cost: each (1) (one) entry is $35. A processing fee of 6.9% will be added to the total cost of each purchase at the time of check out.  This processing fee is to help IWRMS cover the cost paid to Rallyup to manage this raffle.

All those meeting eligibility, as defined below in the “Eligibility” related sections of these Rules, may purchase a ticket. Once purchased, that person’s name is listed on the entry(ies) and that person is the “Entry Purchaser.” 

An eligible "Entry Purchaser” may designate another person as “Entry Holder.” The “Entry Purchaser” will be declared the winner, and the prize will be awarded to the "Purchaser." IWAC will have no further duties or obligations with respect to the division of the prize. The division of the prize shall be the sole responsibility of the "Entry Purchaser," and IWAC is released from all claims relating to the award and/or division among other persons.

Purchaser and Ticket "Entry" Holder Eligibility:

To be eligible to purchase an entry, an entry purchaser (an “Eligible Entry Purchaser”) must (A) be at least 18 years old at the time of purchase, (B) be a U.S. resident physically residing in the United States or District of Columbia, and (C) not be precluded by Applicable Law (as that term is defined in the “Registration with the State of North Carolina and Applicable Law” section of these Rules”) from holding or purchasing a ticket or participating in a raffle.

A person cannot be an eligible “Entry Purchaser” or an “Entry Holder” if such purchaser or holder is a person (A) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List”) or under any statute or executive order or (B) who is acting, directly or indirectly, for or on behalf of any such person.

IWAC Board members and their family members are eligible to purchase entries and win a prize.  

IWAC reserves the right to require reasonable evidence of the eligibility of an eligible Entry Purchaser or Entry Holder at any time and to void any entry sold to a person who does not meet the eligibility requirements or who is precluded by applicable law from holding an entry or participating in a raffle.

Ticket Purchase Details:

Purchase Requirements
Each individual Entry Holder must be named in the same way on each ticket purchased. One method of payment must be used, and the same name must be given on each ticket. It is also required to provide the same email and postal address for each eligible ticket.

 

Purchase Location ~ Raffle tickets may be purchased at https://go.rallyup.com/houndsofeire2025

Purchase Payment and Deadline ~ Purchases may be made by credit or debit card. Tickets may be purchased up until 12:00 Noon EST, June 1, 2025. Monies from any purchase that are processed following that time will be returned.

 

All payments are deposited upon receipt, and entry numbers will be assigned in the order that payment is received. For each eligible entry number assigned, a corresponding eligible entry number will be added into the online drawing. There are no discounts for multiple entries purchased at the same time.

 

Purchasers will receive email confirmation of their entry(ies), and a subsequent email with a link to the livestream RallyUp.com drawing. ​

In accordance with Applicable Law, IWAC will not mail Raffle entries to Entry Holders. To win a prize, Entry Holders do not need to possess a hard copy of a Raffle entry or a receipt and do not need to be present at a drawing.

All Raffle entry sales are final. IWAC will make no refunds with the exception that IWAC will return any payment that is received after the Purchase Deadline.

 

No other refunds are available except at the discretion of IWAC.  IWAC assumes no responsibility for lost, late, misdirected, or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

 

Prize Details:

Grand Prize

  • One trip/round trip to the location of the winner’s choice.

  • The Grand Prize has a maximum value of no more than three thousand five hundred dollars ($3,500) in total, which will be applied to transportation and accommodations. The total value, or any incremental value of the prize is not transferable to cash or any other items of value. It is to be applied to transportation and accommodations only. 

  • Travel itinerary and arrangements will be made by the prize winner. Once arrangements/itinerary has been planned, the winner must contact IWAC in order to arrange method of payment(s). Total payment will not exceed Three Thousand Five Hundred Dollars ($3,500). 

  • The trip can be shared with multiple people or can be transferred to a person other than the Entry Holder, as outlined in the section “Raffle Ticket Entry Information and Designation of Prize” of this Rules and Regulations document.

  •  Travel must be used within one year of the IWAC Grand Prize drawing date.

  • The tax on the value of the Grand Prize ($3500) will be the responsibility of the Ticket Holder.

  • The winner of the Grand Prize and/or their prize designees must comply with all applicable requirements and restrictions related to the prize, including without limitation, applicable travel dates, age restrictions, liability waivers, travel documentation, and reservation and confirmation procedures.

  • All trips are subject to availability and the Grand Prize winner will be encouraged to make plans early to maximize their winning value.

 

Additional Prizes
Additional Runner Up prizes could be donated between the start of the Raffle and the drawing date. These additional donations will be posted on the IWAC Website and announced on the IWAC Facebook page, and on RallyUp.com. Ticket holders are advised to check for these additions to be aware of their potential prize winning(s).

 

Net Raffle Proceeds

As used herein, the term “Net Raffle Proceeds” means the gross proceeds received by IWAC from the sale of entries in the Raffle, less any payment required for prizes (whether or not claimed or awarded in the Raffle), and all Raffle-related expenses incurred by IWAC. The determination of those incurred expenses will be binding in all events, with the exception of any manifest errors made by IWAC within the computation of the revenues and expenses of the Raffle.

 

Prize Restrictions
When selected, the prize will be offered to the winner in “as is” condition, without warranty of any kind, express or implied. The prize and any discernible noted defects will be described on the website: https://go.rallyup.com/houndsoreireraffle.

The prize is awarded to the winner and is non-assignable and non-transferable by IWAC.

 

Reasonable efforts will be made for the winner to take possession/delivery of the prize within 45 days of the drawing. If possession/delivery is not possible, the prize may be forfeited.

NOTE: The IWAC Board of Directors is the final authority in the event of any disputes regarding any of the prize drawings.

 

Drawing Procedure:

Prize Drawings
Raffle tickets will be drawn by “RallyUp.com.” The Number One (1) ticket drawn will be the Grand Prize Trip winner and the following tickets, beginning with Number Two (2) will be the “Additional Prize” Runner Up winners. The number of “Additional Prize” Runner Up winners will be equal to the number of “Additional Prize” offerings.

  1. The “Grand Prize Trip” winner will win the “Grand Prize Trip” or may instead have first choice of any one of the “Additional Prize” offerings.

  2. The Runner Up ticket winners will then be given choice of one remaining “Additional Prize” offering. The order of prize choice for the Runner Up winners will coincide with the order of the draw.

  3. Should the “Grand Prize Trip” winner decline the “Grand Prize Trip,” the “Grand Prize Trip” will then be included in with the remaining “Additional Prize” offerings and may be considered by the “Runner Up” winners in order as described above.

 

NOTE: No entry can win more than one prize. Should an entry ticket be picked more than once during the drawing, only the first pick will be acknowledged

 

Notification of Results

Immediately following the drawing, the results will be posted on the Live Stream and the IWAC Facebook page. In addition, each winner will be contacted by email with notice of their win and directions for how to proceed.

 

Winner Response

ALL winners will be given until 6 PM EST, June 2, 2025 (24 hours from time of drawing) to respond to the notification email.

  • Any winner(s) who do not respond within that 24-hour period will automatically be moved to the position of last choice—this includes the “Grand Prize Trip” winner. If you purchase a ticket(s), PLEASE be sure to attend the Live Draw, check the IWAC Facebook page, and/or check your email prior to the deadline!

  • Once a winner responds, a conversation will be established to facilitate each winner’s choice of prize as outlined and described above.

  • Notification of Winning
    IWAC will make reasonable efforts to contact prizewinners using information provided on the corresponding winning Entry Holder’s purchase email. If a prizewinner does not contact IWAC within 30 business days after the first initial contact notifying the prizewinner of their winnings, then IWAC shall give notice to such prizewinner by U.S. Postal Service certified mail, return receipt requested, at the address set forth in the information provided by the Eligible Ticket Purchaser. This notice shall state (a) the prize won, (b) a telephone number of a contact person at IWAC, (c) the time and location where the prize can be claimed or arrangement suitable for getting the prize to the winner, and (d) that if the prize has not been claimed within 45 days of the date the notification is given, IWAC may, at its option, retain the prize.

 

Regulations:

 

Eligibility to Win
IWAC will not award a prize if the prizewinner (a) was ineligible to purchase an entry or otherwise enter the Raffle, (b) provided materially false or misleading information to IWAMS in connection with the purchase of a raffle ticket, or (c) if participating in this Raffle or receiving a prize is prohibited with respect to such person pursuant to these Rules or Applicable Law. No other Raffle ticket will be substituted for a Raffle ticket, and IWAC will retain the prize. A Ticket Holder cannot assign or transfer his/her interest in a Raffle ticket, or a prize won by a winning Raffle ticket, until after they have taken possession of it.

 

Winner Authentication
As a condition to being eligible to receive a prize, each prizewinner MAY be asked to sign and deliver to IWAC, depending upon the prize won: (a) a sworn affidavit of eligibility under these Rules and Applicable Law and satisfactory proof that he/she is the person named on the winning entry; (b) a correct taxpayer identification number (e.g., social security number, individual taxpayer identification number, or employer identification number), (c) satisfactory proof that the purchaser of the ticket was an Eligible Ticket Purchaser at the time the ticket was purchased; (d) a publicity release, and (e) such other matters as IWAC may reasonably request, such as proof of identification and proof of address to determine authenticity of individual claiming a prize. If the holder of a winning ticket does not provide a correct taxpayer identification number or otherwise comply with Applicable Law or these Rules, then IWAC may, at its option, disallow the award of the prize to such Ticket Holder and retain the prize.

 

Payment Income Tax on Grand Prize Value
Winners of the Grand Prize (valued at $3500) are responsible for paying the required tax amount and reporting the award of the Raffle Grand Prize in accordance with Applicable Law. 

Media Use
Each Entry Holder agrees their name, city of residence, and state may be used in any print or social media without notice or compensation for any purpose including related to this IWAC Raffle or promotional materials.

 

Liability
Each Entry Holder (a) agrees IWAC, its directors, officers, agents, and representatives are not responsible for any injuries, losses, or damages of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless IWAC (as that term is defined in the “Additional Rules Applicable to the Grand Prizewinner” section of these Rules) and their officers, directors, agents, insurers, attorneys, accountants, and affiliated entities from and against all losses, damages, rights, claims, and actions of any kind arising in connection with, or as a result of, this Raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of any prize, or that person’s failure to comply with Applicable Law; and (c) represents and warrants to IWAC that they have read and understand these Rules and agree to be bound by these Rules and IWAC’s decisions, which are final.

 

Dispute Resolution
All claims and disputes arising under or relating to the award of a prize or the conduct of the Raffle, IWAC and all persons purchasing or holding a ticket agree to settle the dispute by binding arbitration in the state of North Carolina, or another location mutually agreeable to the parties. The arbitration shall be conducted on a confidential basis pursuant to, and governed by, the United States Arbitration Act (9 U.S.C. §§ 1-16). Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys' fees. Any such arbitration shall be conducted by an arbitrator experienced in Non-Profit Fundraising and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction. While such arbitration is pending, IWAC, in its sole and absolute discretion, will keep the prize value in reserve deposit until the dispute is resolved by arbitration.  By the purchase of a ticket, all persons purchasing or holding a ticket (a) do submit themselves to the jurisdiction of the appropriate court and appoint the then Clerk, or acting Clerk, of said court as their Agent for the service of all process in connection with such proceedings and consent to the arbitration of disputes between them.  

 

The Laws of the State of North Carolina and Applicable Law
This Raffle is being conducted pursuant to the laws of the State of North Carolina and Applicable Law. If there is a conflict between these Rules and the laws of the State of North Carolina, the laws of the State of North Carolina shall govern. IWAC reserves the right to modify the Rules and/or impose additional conditions, procedures, and requirements as may be necessary or required for the Raffle and the award of prizes here under to comply with the laws of the State of North Carolina and Applicable Law. This Raffle is void where prohibited by law and in states where raffles are prohibited by law.

 

Raffle Tickets "Entries" are Not Considered Charitable Contributions
The IRS has taken the position that amounts paid for chances in raffles, lotteries, or similar drawings for valuable prizes are not gifts and therefore do not qualify as deductible charitable contributions.
